 BE PROACTIVE WITH YOUR CASE.

The most valuable advice to any parent encountering problems with the CSA/CMEC is, be pro active with your case.
If agency errors have occurred, YOU are the person who will have to get them acknowledged and corrected- Join us in the forum for FREE help and advice.

We are seriously concerned  for some, as important time is possibly being wasted.

Instead of promoting the assistance necessary to enable parents to correct errors on their cases and in turn possibly lower huge arrears amounts, members of another group, deadbeat dads are instead -

1) Urged to issue Statutory Declarations, Affidavits, Notices, etc to the CSA/CMEC - Their members cases, which may contain agency errors and could be rectified, are festering within the CSA/CMEC. As such, any arrears may remain incorrectly high, unchallenged and wholly collectible. If owed to the Secretary of State, this is a bonus for the Government!

2) Encouraging payments to solicitors to witness Statutory Declarations, and also promoting payments of expensive court costs to Her Majesty Courts Service (HMCS), in an attempt to attain large amounts from the CSA/CMEC, due to the group rendering the agency in default of their aforementioned Statutory Declarations and Affidavits - These costs could run into £100's if not £1000's and the courts are the same ones the group say 'have NO jurisdiction over the non resident parent', when acting in conjunction with child support laws.

The group state 'if you are referring to the Child Support Act then we suggest you look very closely at it as it is only Legislation, Government Statutes in other words' - Quote Collins English Dictionary  legislation; 1. (Law) the act or process of making laws; enactment. 2. (Law) the laws so made

Be aware, methods promoted by the group in question are NOT fully tried and tested. There is NO guarantee OR supporting evidence, such methods will ultimately prove successful. It is an uncertain experiment that could result in heavy financial loss or burden for those involved. Some information they provide is incorrect.

Before venturing down such a route; a) Query and satisfy yourself of the legal expertise / knowledge of the people making authoritative statements about UK laws. b) Question their success rate. c) Request to see legal supporting case evidence. c) Query the outcome of the aforesaid group founder's own child support case - The agency refuse to speak with him. Would you consider being suspended from your employment a sucess? (he did!). 

Remember, fools rush in where angels fear to tread - be careful!!

 IMPORTANT - ARE YOU ENTITLED TO A REFUND?

In April 06, changes were made to child benefit rules, allowing child benefit to continue to be paid to parents with care, for children over 16 yrs and registered for/attending certain government approved training courses.
However, relevant child maintenance legislation should have also been updated - which it was not.

Therefore, some non resident parents will have made child maintenance payments for children who were affected by this change, between 10 April 2006 and 9 November 2009, which the existing legislation did not allow for.

If you are affected by this, you may be entitled to a refund.

Note for parents with care - if your ex is entitled to a refund because of this, you will not be expected to re pay the money you received.

OUR PURPOSE

'afairercsaforall' forum offers free impartial help, advice, support and general information for ALL parents involved with the CSA / CMEC, regardless of whether a case is on CS1 or CS2, with matters including; Maladministration, Delays, Mistakes,  Arrears, Phasing, Child Support Law, The Child Support Act, Enforcement Action ~ Liability Orders (LO), Deduction of Earnings Order (DEO), Bailiff Action and rules, requesting Data Protection Files (DPF) and how to complain. A variety of other topics including; Tax Credits and Bankruptcy are also covered.

There is also a Campaign Section ~ we are not extremists. However, if talking does not work and members choose to take direct action, as a group, we WILL go with the majority ~ together, unite for fair change!

GROSS MISCONDUCT AND NEGLIGENCE - Do you know of a case thats been subjected to this?

In this series of videos, by one of our members, he details his experiences with the CSA and the catastrophe he and his daughter now face - loosing their home.
As with many other cases, this is not a case of non compliance, but a case that has over a period of time, been subjected to gross misconduct and negligence by the CSA and others.

In a statement to afairercsaforall our member confirms;
'I have a back ground/qualifications in investigation methodology and for the last five years I have been compiling a case against a significant number of officers, who it appears were collaborating. They even lied in court submissions and to my MP. Senior civil servants and government ministers are also implicated.'

FOR THE ATTENTION OF THE GOVERNMENT

Our group requires the UK Government to recognise that the current Child Support system is unfair and flawed on many levels. As a group, we are represented by PWC and NRP, all with a common cause. We are not  extreamists and will happily meet with CSA / CMEC representatives, Legislators and/or Law makers to discuss the systems flaws, in an attempt to quite simply achieve a fair, balanced system for ALL parents and more importantly ALL children caught up in the trauma of relationship breakdown.
