Shall we look at the above quote “WE ARE DOING THINGS RIGHT”.  Okay,  lets look at bailiff laws. We will start with entry into a property.........

What bailiffs can and can't do
If bailiffs come to your home, you don't have to let them in.

They can't force their way in on their first visit, but they can climb through an open window, or use an unlocked door. Forced entry includes pushing past you once you have opened the door  or forcing their foot in the ajar door to prevent you closing it. Such actions would make the whole process illegal.

Bailiffs trying to recover money you owe to HMRC are allowed to break into your home, only if  they have a magistrates' warrant.

Bailiffs recovering unpaid magistrates' court fines, however, do have the power to force entry.

The CSA are not HMRC nor are they recovering unpaid fines......... So WHY ARE BAILIFFS FROM MARSTONS  DELIVERING NOTICES STATING........ I quote “ If you fail to make immediate payment we may re-attend  your premises with a locksmith, remove goods in your absence and sell these goods at public auction” ?
 

Shall we revisit bailiff law.

Can a bailiff force his/her way into my house?

Most bailiffs do not have any rights to force their way into your home to seize goods. The only exception is bailiffs from the Collector of Taxes (Inland Revenue) they can get a warrant to force entry, though this is very rare.

All other bailiffs have a right of peaceful entry only. This means that it is illegal to use force to enter your home, for example, by breaking a window or a door. However, they can enter your property through an open door or window (front and back) they can also  climb over fences and gates, but cannot break them down.

You do not have to let a bailiff into your house. A bailiff cannot force their way past you if you answer the door, nor stop you closing it by putting a foot in an ajar door, these actions are illegal. If all your doors and windows are securely closed they will not be able to gain peaceful entry to your house unless you let them in.

Bailiffs are well aware of their very limited powers and may attempt to use a variety of different tricks to gain entry peaceably. They may attempt to walk in as soon as a door is opened. They may ask if they can use your telephone to check if an arrangement is satisfactory with their office, or even your toilet.They may simply ask you if you would prefer to discuss matters inside. You do not have to go along with any of these methods.

Can I be arrested or imprisoned for not letting a bailiff into my house?

No. If a bailiff is accompanied by the police, they are only there to prevent a breach of the peace. You cannot be arrested for refusing to allow a bailiff into your home, refusing entry is your legal right

You cannot be imprisoned for not paying your debts. However, non-payment of council tax, child maintenance or magistrates court fines can lead to imprisonment if you 'wilfully refuse' to pay. This means that the magistrates must be satisfied that you have the money but choose not to pay. You should be required to attend a magistrates court means enquiry hearing before this is decided. This gives you the chance to explain why you have not paid, and produce evidence of means and ability to pay

I think that clears that up....... 

As the example below shows, bailiffs are putting threatening, misleading notices through peoples doors. THREATENING BEHAVIOUR IS A CRIMINAL OFFENCE.  Think about it.......

Bailiffs and Marstons

Hi all just found this forum and already it has eased some of my worry.
Got home from work one night last week to find a letter from marstons waiting for me and i have been worried every since.

I have just printed of the letter for them found in the download section and it will be in Mondays first class post.
